Scotland’s police announced on Tuesday that J.K. Rowling did not violate the law with her tweets criticizing the new hate speech legislation in Scotland and referring to transgender women as men.

The author of the “Harry Potter” series is an outspoken opponent of the new law, which went into effect on Monday, making it illegal to incite hatred based on characteristics such as age, disability, religion, sexual orientation, and transgender identity.

Rowling is part of a group of critics concerned that the law could suppress “gender-critical” feminists who argue that the rights of transgender women should not overshadow those born biologically female.

In a series of tweets, Rowling referred to several prominent transgender women as men, a move that could potentially constitute an offence under the new law in certain circumstances.

Rowling expressed her readiness to face arrest if her tweets were deemed offensive under the new legislation, stating, “Freedom of speech and belief is at an end in Scotland if the accurate description of biological sex is deemed criminal.”

While complaints were filed with the Scottish police, they concluded that Rowling’s comments did not constitute criminal behaviour and no further action would be taken.

Scotland’s semi-autonomous government defends the new law, known as the Hate Crime and Public Order (Scotland) Act, to combat hatred and abuse. However, critics argue that it poses a threat to freedom of speech.
