Fulton County District Attorney Fani Willis has been disqualified from her election interference case against President-elect Donald Trump following a Georgia appeals court ruling citing an “appearance of impropriety” due to her prior affair with special prosecutor Nathan Wade.
Attorney Ashleigh Merchant, who first exposed the improper relationship, reacted to the decision on Fox & Friends, asserting that Willis clung to the case to avoid exposing its weaknesses.
“She could have done the right thing early on… and said, ‘Let’s have a neutral prosecutor handle this case,’” Merchant said. “But I think she was terrified because her case was so weak.”
Earlier in March, Judge Scott McAfee had given Willis a choice: step away from the case or remove Wade. Wade resigned, allowing Willis to remain. However, the appeals court’s ruling on Thursday deemed her disqualification necessary to uphold public confidence.
Merchant viewed the court’s decision as inevitable: “It’s the appearance of impropriety. It is so great that it had to be enough to kick them off the case.”
Merchant believes a neutral prosecutor would dismiss the case entirely, noting, “If someone who didn’t have a financial or political interest in this case looked at it, they would decide the taxpayers and the courts deserve this case to be dismissed.
